These Terms and Conditions shall govern the relationship between you “the Consumer” and FalkosGold both as a user of the website and a customer of FalkosGold.
Online Calculator
The online calculator located on the website is solely for the convenience of the Consumer and is only to be used as providing an estimated price of the precious metal item(s). The online calculator is based upon the presumption that the information provided by the Consumer is accurate (based upon the current market value of the precious metal on the day of use, and not necessarily the price of the precious metal on the day FalkosGold receive your item(s)). The price that is generated by the online calculator is not to be treated as an offer for which FalkosGold will be bound by, which the Consumer accepts by sending the item(s) to FalkosGold. The Consumer is aware that all item(s) will be tested for accuracy.
Requirements for Use
You warrant that;
- you are at least eighteen (18) years of age; and that
- you are acting on your own behalf; and that
- you have good and unencumbered title to the item(s) you send in to us; and
- you have the appropriate authority to sell and transfer the item(s); and that
- the said item(s) are sold free of any charges, liens, encumbrances and claims of any nature and description whatsoever including those of any third parties; and that
- the said item(s) are not derived from, or been created by, as a result of activity which is either illegal or immoral in either the jurisdiction of England and Wales or any other country; and that
- any matter initiated by you will not result in FalkosGold being in breach of any money laundering, terrorism, or any other laws of England and Wales or of any other country; and that
- you are the sole proprietor of any item(s) offered to be sold to FalkosGold and the legal and beneficial owner in respect thereof. FalkosGold reserve the right to ask you to provide documentation or other proof of such ownership.
Further, FalkosGold reserve the right to request documentation or other proof of your ability to abide with the requirements stipulated at (a) to (h) above.
Shipping
The Consumer is responsible for ensuring that all item(s) are packaged appropriately when sending the item(s) to FalkosGold.
FalkosGold will not accept any liability for any damage, breakage and/or loss to the item(s) whilst in transit to them.
It is the Consumer’s responsibility to ensure that the most appropriate shipping and insurance for their item(s) is selected.
FalkosGold strongly recommends that the Consumer sends all item(s) using Royal Mail Special Delivery together with the appropriate level of insurance. FalkosGold does not endorse the use of Royal Mail Recorded Delivery as this does not offer either sufficient insurance or security, if at all.
FalkosGold reserves the right to reject any item(s) which appear to be damaged, opened, or tampered with. Any such item(s) will be returned to the consumer by FalkosGold via the post office.
Precious Metal Testing and Weighing
FalkosGold will test and weigh all item(s) sent to them by the Consumer upon receipt of the same. As a result of such testing, the item(s) may become tarnished. However, such tarnishing is usually superficial and can normally be polished out.
In the event that it is necessary to scrape a very small sample of metal from the item(s) sent in by the Consumer, FalkosGold will endeavour to ensure this is done on an area of the item(s) that is not easily visible.
Any item(s) sent to FalkosGold incorporating non precious metal material (e.g. glass, stones, enamel, steel or other metals) will be removed prior to weighing and testing in order to ensure accurate testing is undertaken. The non precious metal material may be damaged in the process and as such FalkosGold accepts no responsibility for any damage caused in respect thereof.
In the event that FalkosGold determine that an item is actually non precious metal, the item(s) having been tested, the item(s) will be returned to the Consumer via Royal Mail Special Delivery and FalkosGold reserve the right to charge for this.
Payment
Providing the final testing, weighing and valuation carried out on the item(s) does not differ to the initial quotation and the item(s) are received within 2 working days of the online calculation then the estimated price generated by the online calculator will be honoured.
However, in the event that the final testing, weighing and valuation differ significantly from the online calculation, or the item(s) are received more than 2 working days after the online calculation then the online calculators estimated price will not be honoured. In such circumstances a new price will be provided.
In all circumstances the Consumer will be contacted for authorisation prior to the payment being made in accordance with the Consumers preferred payment method. If for any reason the Consumer does not wish to accept FalkosGold’s offer to purchase the items then FalkosGold will return the items to the Consumer.
If FalkosGold have incurred any costs in dealing with the consumers’ precious metals and the consumer changes their mind, then FalkosGold reserve the right to pass these costs onto the consumer prior to returning the goods.
FalkosGold reserves the right to return any item to the Consumer.
